38. An employee is entitled to a 30 minute meal period with pay for each work period of 5 consecutive hours per day. If the employee is unable to take advantage of the meal period, the employer pays an indemnity corresponding to 30 minutes of wages. Remuneration for meal periods does not operate to create overtime.
